I still find it very strange that Francis Byrd, the Twitty twins and the other boy who Natalee had been to dinner with the night before does not have any affidavits included with this filing.

JQK was on the phone for long time today with Karin Janssen. Before I ask about the phone call, what did your client think about the Dutch tv program?

John:

They were very about the efforts, that they're staying on top of the search, nobody has criticized anybody when the efforts are being made

Greta:

Why were you on the phone today with Karin Janssen?

John:

SHe called me a couple of times, she's very diligent, she wanted to let me know about 60 tips and anticipating more, it will take several days to follow up she was really upbeat. The other thing they are doing is land searches, we've eliminated certain possiblities but there's more to do.

They're engaged in water searches with the coast guard; they're searching in shallower areas with divers, they'll be picking up again in a few days.

Greta

Did Karen pull you aside and tell you we got one really good tip.

John:

No, she said she's very optimistic, some of the info will be followed up on, she knows about crank calls but there are definitely some legitimate ones.

Greta

We heard things about fireworks in January, Dompig told reporters something big would happen in 24 hours..Is there anything more than great tips, something substantive

John;

She didn't indicate there's been a break, she was enthusiatic but didn't indicate that one particular tip or phone call was going to be THE tip that would result in answers

Did you feel this is great news or ok let's hope something comes out of this?

The latter, they're trying, we've never criticized that, it's a long shot.

DO you have more than one theory

John;

I'm opened minded, until we have answers, there are different possibilities.

Greta:

Julia Renfro says she saw a video at 3 a.m. it could have been Natalee, that Beth looked and does not think it's Natalee, Do you know if the tape was turned over for enhancement?

John:

SUre, I know Beth looked at it very carefully and said it's not Natalee.
She seemed very comfortrable very definitive that it was not Natalee

Greta:

Somebody using a key card after midnight, any info on that?

John:

It's a non event, that card key was used next day too by other girls, it was not Natalee's. As a matter of fact that's the info Beth tracked down herself and gave to ALE

Greta:

DO police believe Joran took Natalee to the beach or she went somewhere else with Joran

JOhn:

Last time I talked to Dompig they were on the theory it was the Marriott beach

Greta:

ANybody else have a different theory? Care to share with the class?

John:

NO. There are a few other theories too, but none I want to share tonight

The van der SLoot attorney says the civil suit belongs in Aruba.

There's a civil suit in the New York Court, brought by Natalee's family The van der Sloots say it's very inconvenient to got to New York The lawyers for Natalee say all the witnesses are here in the U.S.


Professor:

This is a real tough one to predict I have to invoke the great philosopher, Casey Stengel ...

This dismissal is completely within the discretion of the trial judge. SHe will look at all matters relevant and the burden is on the van der sloots to show that NY is inconvenient and that an alternative forum in ARuba does exist

We were right on the jurisdiction, it seems they would dismiss because there is no connection, there was this aruba court, Now that I've read the papers I'm not so sure anymore, there seems to be a stronger case for it staying in New York.

Greta:

It's a dice roll, they walk in to argue but nobody has any certainty about it I guess.

Professor:

Exactly right, whatever the trial Judge decides will not be overturned on appeal...it will be reviewed for abuse of discretion. Again there are various factors that are important but what we think is not important. One of them is the fear issue of Aruba. For there to be a dismissal Aruba has to be a viable forum it does not have to be a clone of American law. I think there's a very strong argument that it is not a viable forum.

Greta:

ONe of Natalee's classmates says she's afraid to go back to ARuba, but would testify in Ny..Is that good enough...

Professor:

No factor alone is enough, it's the aggregate, but courts have looked at this emotional impact to go back to a place, there was a case in Federal Court where the Court refused to dismiss because it would not make the parties go back to a country where their relatives had been killed.

There's been threats to Natalee's mom, death threats, it's not determinative, you don't want people to oust a court of jurisdiction, but Aruba doens't seem to want this case

Greta:

If you were deciding the case, would you be sure you're right?

Professor:

No, absolutely not.

Just when you thought you heard it all, we have a new twist for you. ALE wants to talk to a man who sexually assaulted a woman on a beach. The police have known about this for months but only now release a sketch of the alleged perpetrator.

Live and Direct is Tracy Allen, this is the woman who fought off an attack on an aruban beach. This is her first interview since the sketch was done and released to the public. You reported this the day it happened didn't you?

Tracy:

I think I was a little naive, I thought that they would handle it from the beginning. It's only when I decided to go to the press that they followed up

Rita:

You were near the fisherman's hut

Tracy:

I went for an early morning walk by the fisherman's hut, a man accosted me, fishermen arrived when he started assaulting me, he knew it wasn't going further, and fled and I went to the hotel

Rita:

He assaulted you? What did he do?

Tracy;

He was wearing just a shirt, he grabbed my arm several times, I held my ground and didn't go to his car, he threatened me and fled

what do you think he intended to do?

Tracy:

If I did what he said I would get raped, his car was running so he was trying to get me to the car...I was afraid for my life

Rita:

This is where Joran supposedly took Natalee that night, near the fishermen's hut ...this is 9 days before Natalee vanishes

Tracy:

I signed a statement, they said they would look into it. I heard nothing. When Joran changed the story and said heleft her there at the beach, I contacted the FBI I tried several timess to contact ALE, I got hold of Twitty/ Holloway family. Then I got in touch with TES and Tim Miller started to pressure ALE, it still didn't happen

Rita:

You go to the aruban authorities and you don't get any calls back from ALE?

Tracy

No, first time I was contacted..the FBI took my statement and didn't contact me again until December 2 when I did the sketch

Rita;

This is the sketch you contributed to ALE..is this a local guy do you think?

Tracy

I believe he was local, he had an older car, not like a newer rental car that a tourist would have.

Rita

Do you think this man is capable of, he sounds like a very dangerous man

Tracy

It was only for a lack of opportunity that I escaped. I think other women probably hve had contact with him, I hope ALE will take it seriously now

Rita:

How disappointed are you by the investigation of ALE?

Tracy

I don't know if it's related or not to Natalee, as time goes by there's less evidence if it's related.

Rita

Would you remember him if you saw him again?

Tracy

Absolutely, I was 8 inches from him for 4 minutes
It very well could be related to Natalee, I hope they find him for the safety of all the women in Aruba. the aruban women should demand it, he's a sexual predator, he needs to be caught.

Rita:

Shame on them for not following up on this

I want to get to Joran's defense attorney, Joe Tacopina back from aruba. THis is pretty incredible, she feared for her life thought he would rape her or worse. Now finally they put out a sketch, why wait so long, were you looking for him when you were in Aruba?

Tacopina:

I wasn't looking for him, my investigators are still down there and they were. I have to tell you, this is so despicable that 11 months later we are putting out a sketch of an individual who might or might not be related to Natalee's case. Let alone Tracy's concern about finding this guy I watched that re-enactment with the van der Sloot family, they actually were pleased to hear this new superintendant, a legally educated man, trained in legal schools in Aruba

They have more faith, we certainly do. For starters the first words out of his mouth, the sketch was put out and he said they have to follow up. How useful is it 11 months later, he could be anywhere why did DOmpig and other investigators, ppl who just wanted to find something about Joran...ignore something like this....they've now seen video of Natalee at 3 a.m. why is this coming out now, pieces pointing away from Joran
We spent 3 days down there with lawyers and this is what we were focused on..

Rita:

It is shocking regardless of where this case goes, they didn't look at this person and now, finally they put out a sketch.

Rita:

Natalee's father joins me next to tell about this assault that happened where Natalee may have been the night she disappearaed. He has a new book out, I'll talk to him about that as well.

Rita:

You just heard from the woman who gave ALE that sketch. With us here tonight is Dave Holloway, author of the new book Aruba: The Tragic Untold Story of Natalee Holloway ...

It is so great to see you in person, we've been praying for you so much

Tracy Allen, I was very surprised to hear what she said. She reports it to authorities and notihng happens. Here we are many months later and they put up a sketch

Dave:

She contacted TES and I spoke with her, she wanted a copy of the police report. We went through our attorney down there to get it, I have a very good physical description of him and the vehicle. Art Wood and I were down there, a car came by and I thought it looks like the guy, we wrote down the tag #. We gave it to the police

We don't know what they did. Tracy called us a month later and asked if we gave that to police and we told her yes.

Rita:

You hear her story today, how outrageous is it that they're only putting out a sketch of the guy now?

Dave;

It's typical of how this investigaton went

Rita:

Let's play a portiont of the Arrest Requested Show where they talk about the tipster from Columbia.

How hard is it for you to see so many tips, how did you sort out what to put into your book?

Dave:

You provide tips to the police and they don't follow up. We put everything in the book all tips, leads, maybe somebody will read it..if police read it they'll understand

Rita:

The show has received dozens of tips, will something come of it do you think?

Dave:

I need to get phone # for the Dutch tipline and call my tips in to them

Rita:

Hats off to you for all the investigation you've done,. You've fought so hard for the truth

Dave

The truth will come out eventually, I thought we would have resolution in weeks at most, but 11 months is totally not right

Rita:

We get so many e-mails saying how is Dave, they have lot of questions

Here's one e-mail question: Is it possible that Natalee was raped and drugged on a boat and then dumped in the ocean?

Dave:

they didn't find anything in the sand dunes, so ....

Rita:

has anyone ever found out what Paul was doing when Natalee went missing?

Dave:

That concerned me when Paul said no body no case, his attorney made that statement I think. I think Deepak aldo said Paul made that statement as well, it was very strange...when I was out searching it was hard for me to take remembering that statement.

Rita:

wHAT HAS BEEN THE hardest thing for you?

Dave:

The time factor. I left Meridian, Mississippi and the statement that the pastor told us was "God give Dave the strength". we carry that burden ..

Rita:

The country is carrying it with you too, Dave.

Dutch tv broadcast a re-enactment using all kinds of liberties. It's all bizarre ... what do you think about this, is it exploitation or what?

Beth:

I was a little concerned, when I see some of the things that came out, there's been good things. We're getting the reward money out in Bonaire, Curacao and Holland Another thing, they're allowing citizens to call into a different tip line, some have been uncomfortable about calling into the aruban tip lines, that's never been a secret.

Bill:

What about the portrayal of your daughter as a reckless party girl, there's a scene where she's leaving C&C and her friends said don't go, but she leaves anyway

Beth:

I really did detach myself from that aspect, what hit me was the first time I saw footage of Deepak's car leaving C&C, I dd not know that existed, the clips of that I know it was my daughter who thought she was being taken back to the Holiday Inn. I didn't know that footage existed

Bill:

Another woman was sexually assaulted 9 days before, you knew about that?

Beth

I spoke with that young lady several times, I knew about the man, middle of summer maybe July. The FBI had given me some information on it, not that they felt it was connected. It was a crime commited on one of the tourists.

Bill:

They haven't found him, so there's two people out there, they don't believe this sexual assault 9 days prior is connected to Natalee. Again it raises the question about is there anybody in aruba in charge. Dompig is replaced how do you feel about that?

Beth

I don't even know if we haven't just been deceived, I don't think he's replaced, it's terminology to deceive us to think someobdy else is in charge, I'm not certain I buy it, he's probably still there

Bill

Well, he's still in the police department, he certainly embarassed the country of ARuba doing 48 Hours interview, saying crazy things. The FBI are they in touch with you on regular basis?

Beth:

NOt regularly for some time, the last update was when Aruban authorities were coming to the U.S. to interview students.

Bill:

You are in Washington, you've set up a foundation there

Beth:

It's under construction right now, we're trying to provide in depth information to ppl travelling abroad.

Bill:

You're hoping for corporate donations right, companies to help you out?

Beth:

Right.
