Virginia General Assembly votes to ban health-insurance mandate

Although opponents say that requiring health insurance would be similar to requiring a driver to have auto insurance, and that federal legislation would preempt a state law, the Virginia General Assembly isn't buying the argument:

The Virginia General Assembly has given final approval to a bill that would make it illegal for the government to require individuals to purchase health insurance, a measure intended to conflict with Democratic efforts to reform health care in Washington.

Thirty-four other states are weighing similar legislation to block the individual mandate, which is an element of bills that have passed both the U.S. Senate and House of Representatives. But Virginia is the first state to complete legislative action on such a bill.

The NYT noted back in September 09 that state laws such as this are likely to "set off a legal battle over the rights of states versus the reach of federal power" - an issue that is, for some, central to the current health care debate but also one that has tentacles stretching into many other matters, including education and drug policy, but that some constitutional scholars say the proposals are mostly symbolic.

However, be they symbolic or substantive and effective, if these laws do nothing more than just that - "set off a legal battle over the rights of states versus the reach of federal power," it'll be damn well worth the effort since it at the very least makes people rethink the direction our country is headed in an Obama administration - a nanny state that controls every aspect of our lives.
