'Obama Sued in Philadelphia Federal Court on Grounds he is Constitutionally Ineligible for the Presidency' - Is This For Real? (Updates)

TexasDarlin has a post up that she has received word that that ALL MEDIA were asked to report to the U.S. District Courthouse in Philadelphia this afternoon - Case #08-CV-4083. (I'm willing to bet that no one from the MSM showed up). I'm guessing this is a shot in the dark by PUMAs, but who the hell knows at this point.

The motion will be for an emergency temporary restraining order prohibiting Obama from running for president, and enjoining the DNC from nominating Obama as the Democratic presidential candidate.

According to by Jeff Schreiber at America's Right.com:

A prominent Philadelphia attorney and Hillary Clinton supporter filed suit this afternoon in the U.S. District Court for the Eastern District of Pennsylvania against Illinois Sen. Barack Obama and the Democratic National Committee. The action seeks an injunction preventing the senator from continuing his candidacy and a court order enjoining the DNC from nominating him next week, all on grounds that Sen. Obama is constitutionally ineligible to run for and hold the office of President of the United States.

Phillip Berg, the filing attorney, is a former gubernatorial and senatorial candidate, former chair of the Democratic Party in Montgomery (PA) County, former member of the Democratic State Committee, and former Deputy Attorney General of Pennsylvania. According to Berg, he filed the suit--just days before the DNC is to hold its nominating convention in Denver--for the health of the Democratic Party.

"I filed this action at this time," Berg stated, "to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.".

Berg cited a number of unanswered questions regarding the Illinois senator's background, and in today's lawsuit maintained that Sen. Obama is not a naturalized U.S. citizen or that, if he ever was, he lost his citizenship when he was adopted in Indonesia. Berg also cites what he calls "dual loyalties" due to his citizenship and ties with Kenya and Indonesia.

Even if Sen. Obama can prove his U.S. citizenship, Berg stated, citing the senator's use of a birth certificate from the state of Hawaii verified as a forgery by three independent document forensic experts, the issue of "multi-citizenship with responsibilities owed to and allegiance to other countries" remains on the table.

In the lawsuit, Berg states that Sen. Obama was born in Kenya, and not in Hawaii as the senator maintains. Before giving birth, according to the lawsuit, Obama's mother traveled to Kenya with his father but was prevented from flying back to Hawaii because of the late stage of her pregnancy, "apparently a normal restriction to avoid births during a flight." As Sen. Obama's own paternal grandmother, half-brother and half-sister have also claimed, Berg maintains that Stanley Ann Dunham--Obama's mother--gave birth to little Barack in Kenya and subsequently flew to Hawaii to register the birth.

"If", and that's a BIG IF, this isn't all some kind of hoax or a simple case of the Obama campaign not having provided the correct information or certificate, or there's some other legitimate explanation, all hell is about to break out in the Obama campaign and Hillary Clinton will have pulled off a hell of a coup!

Update; Factcheck.org (owned by The Annenberg Foundation) has a new birth certificate story. As Texasdarlin suggests in her post, this is interesting timing since Obama has just returned from Hawaii. Indeed, what a coincidence that it's today!

Dear Abdul:

Bravo again!

Berg's argument is accurate. However Barry Soetoro responds, he will entrap himself in perjury.

The Kenya argument seems fragile on the grounds that Barry's mother was under the jurisdiction of the USA at the time of Barry's alleged birth (one of the conditions of citizenship conveyed by birth). The tender spot is whether or not the Barry born in Kenya was in fact this American woman's son!

Second, the Indonesian argument is powerful, because when Barry was adopted by the Indonesian father, his mother (under the jurisdiction of the USA at the time) gave her consent ... essentially dismissing Barry's citizenship in the USA in preference to Indonesian citizenship (no dual citizenship in Indonesia).

Now, the argument follows that Barry's mother returned to the USA and enrolled him in a private school (easier to pass document scrutiny than public schools) under his old US passport's identification and omitted all Indonesian credentials. Truly, the Obama family should rig their ship for heavy storms here. Perjury reeks everywhere!

I didn't see the all-media thing until after I had the complaint in my hand. And no, nobody from the MSM showed up.

Now, I may be one of the only folks with the hard copy of the filing--you are absolutely right on the case number, by the way--but come about 9:00am, it will be online for just about everyone to see.

You know, I can't assess the truth of Berg's arguments. They might be right; they might be wrong. Still, the MSM hasn't been forthright in vetting Obama, perhaps a result of the love affair, and any scrutiny is good scrutiny.

Jeff, at least this ought to air the COLB issue out once and for all, and hopefully, all the associated nuance with it. Even Obama himself was very vague in his books about his real history. My bet is that there is some truth to the Indonesian and Kenyan side of the story (ies).

Dear Abdul:

Concerning Barry's birth in Kenya, as described in your post:

In order for Barry's American mother to confirm that he was born in Kenya to her, she requires what they refer to today as a Consular Report of Birth Abroad (FS-240). The FS-240 gets issued once the consulate (embassy) concurs with (approves) an application submitted for the form (Application for Consular Report of Birth Abroad. DS-2029).

The foregoing are the consular form numbers employed today. What they were in the 1960s, I do not know. However, the US State Department should have copies of both documents in their files. If these forms are not present (both) in the US State Department's files, then it is likely that Barry's mother never experinced a live birth in Kenya. Consequently, either Barry was born in America or Barry's mother smuggled someone else's child into the USA.

The documents will tell the story!
