Chávez Decree on Inteligence
Topics: VenezuelaChávez has issued a new Law on Intelligence which is a terrible danger for freedom inside Venezuela. I translate the article 20 which is the most dangerous of all:
If the orders lapse upon definite or irreproducible facts or there is a founded fear of their extinction or disparition, or the commission of a crime is imminent, those orders will be executed by the Organs with Special Competences without requiring any judicial or prosecutor's order. The dilligences thereof should be justified by means of a motivated act, in which the presence of any of the conditions expressed beforehand should be indicated. The operative and research orders will be executed in protection of the Security and Defense of the Nation. The results of those dilligences will have the character of a technical proof and will be freely incorporated to the pertinent judicial process. The right to defence will be permitted afterwards, in all its forms of expression and specifically in relation with the control of the evidence and the controversial (facts).
The problem, as you can understand, is that those "Organs with Special Competences" are not judicial and can do nearly whatever they want if they consider that it's needed for the "protection of the Security and the Defense of the Nation".
The reason Chávez has given to pass this law is, as always, "US imperialism":
Mr. Chávez, who has insisted the defeat will not dampen his ambitions to transform Venezuela into a Socialist state, said the new law was intended to guarantee "national security" and shield against "imperialist attacks."
