Writing at NRO today, Daveed Gartenstein-Ross - an attorney and counterterrorism consultant, sums up USA Today's report on government data collection and says that it does not, as described and on its face, violate the Fourth Amendment or FISA. As Ross points out and as could be expected, the story's publication has accompanied by a torrent of criticism directed at the Bush administration. A quick scan of liberal blogs shows that the program is being attacked as not only unwise, but also illegal.
(...) Yet for this to be true, an actual law must have been broken. Yet the two most likely legal authorities--the Foreign Intelligence Surveillance Act ("FISA") and the Fourth Amendment to the U.S. Constitution--do not prohibit the alleged government activity.What makes the Ross article so interesting is that he offers sufficient legal detail to back up his statement that the Left is yet again - dead wrong.(...) Of course, the fact that a government action is legal doesn't settle the case: There may still be ample room to oppose it. But there is a rush among broad sections of the Left to declare illegal any Bush-administration policies with which they disagree without being troubled by such trivialities as what the actual, settled law says. Here, this reflexive reaction appears dead wrong.

A majority of Americans initially support a controversial National Security Agency program to collect information on telephone calls made in the United States in an effort to identify and investigate potential terrorist threats, according to a Washington Post-ABC News poll.BTW, the 35 percent that believe that it's better to wait and get nuked into oblivion by terrorists than collect information on telephone calls made in the United States in an effort to identify and investigate potential terrorist threats, are Left-wing nuts living in a dreamworld of non-reality, and nothing will bring them out of their mental and emotional cave. The rest of us will have to think for them and help keep them safe from harm.The new survey found that 63 percent of Americans said they found the NSA program to be an acceptable way to investigate terrorism, including 44 percent who strongly endorsed the effort. Another 35 percent said the program was unacceptable, which included 24 percent who strongly objected to it.
A slightly larger majority--66 percent--said they would not be bothered if NSA collected records of personal calls they had made, the poll found.
Underlying those views is the belief that the need to investigate terrorism outweighs privacy concerns. According to the poll, 65 percent of those interviewed said it was more important to investigate potential terrorist threats "even if it intrudes on privacy." Three in 10--31 percent--said it was more important for the federal government not to intrude on personal privacy, even if that limits its ability to investigate possible terrorist threats.
Half--51 percent--approved of the way President Bush was handling privacy matters.
