HarryTho 12/21 Natalee Holloway Update And Commentary

Topics: Natalee Holloway

This evening I felt I should highlight a post from "paul" concerning the four resolutions on record from the Alabama legislature concerning the case of Natalee Holloway's disappearance. I felt all our readers should have the opportunity to witness the workings of a state legislature. The commentary provided by "paul" is sufficient.

The text of state resolutions concerning boycott of Aruba are attached below.

There are four resolutions - at search site use holloway as key word. Please note the exact verbage implies prosecution demanded for Joran Van der Sloot, a threat to tourism, a inference of Aruban negligence lately disallowed by Bachus interview,as well as documenting the participation of Jug and Beth Twitty in an act of state when they are not elected.

Resolutions, Legislative
Alabama, State of
Aruba Tourism

From the foregoing, we witness the building of premises then a sudden jump into resolutions on the part of Alabama legislature. This actions resembles more the slap-draw action of Western gunslingers than assembly of civilized individuals.

There exists no Acknowledgment clauses whatsoever. In other words, under what guidance does the Alabama legislature reference to even create such a document. Frankly, I will refrain from assuming what form of guidance that I believe was employed in the creation of these four documents.

There exists no reference to Recognition whatsoever. In a sense, the Alabama legislature chose to ignore creating a foundation for this document. Of course, it would follow that if the Alabama legislature refused to reference any legal reference than it would follow that they abandoned recognition, as well.

There exists no Bearing In Mind clause with which to demarcate the scope of the intended effect of these documents. Without such a clause, one could imagine a full scale assault upon the economy of Aruba and the Kingdom of the Netherlands in general.

There exists no Desiring clause in order to expound upon the specific intentions of the resolutions. Clearly, these resolution were enacted and promulgated with no intention in mind. They read more like "To Whom It May Concern" followed by "Don't Tread On Me."

I find it difficult to believe that licensed attorneys produced such documents More so, I find it as unbelievable that these inept resolutions were accepted and approved by legislators with presumably some access to legal counsel.

The way these resolutions read, the Alabama legislature connected a serious of statements and assumptions with the repeated use of the word "Whereas" and then simply drew resolutions. Perhaps, the vocabulary and mental processes of the Alabama legislature are in such an infantile state that simple words have to suffice. One can sympathize with cavemen and farm animal handlers in such a case; however, I suspect that a few licensed lawyers from the state of Alabama crafted these resolutions. If the foregoing four resolutions exemplify an example of the Alabama administrative prowess, we can certainly appreciate why the federal government instituted the No Child Left Behind Act. Alabama has been left behind.

One issue ignored in the resolutions refers to the hundreds of missing people in Alabama. The Alabama legislature's abandonment of that issue speaks clearly that these missing persons were of no consequence and therefore ignored entirely. Rather than condemn the Alabama legislature for ignoring their missing persons, I will simply conclude that the Alabama legislature's inability to express itself legally encompasses this glaring oversight. Succinctly, they were not astute enough in order to include these missing persons.

I will move on to another topic and await the edification of the Alabama legislature.>>>>

From the Amigoe Newspaper, we read that Jossy Mansur's newspaper has brought claims of fraud against Minister for Justice Rudy Croes:

ORANJESTAD -- The AVP wants the District Attorney to investigate the alleged irregularities by Justice minister Rudy Croes (MEP). According to the AVP there are more than enough indications that the minister and his colleagues have committed possible misdemeanors, which is why the fraction of the green party handed a letter to the DA yesterday.

In the letter, directed to the Attorney General Theresa Croes-Fernandes Pedra the AVP writes: "As you already know we informed the DA in the last mentioned case of the corruptive practices within the Ministry of Justice and the DINA. We have also reported a felony committed by the minister of Justice, H.R. (Rudy) Croes. You however concluded In said case, without even investigating the matter apparently as the ladies in question were not even interrogated, that there was no just cause for a criminal investigation."

The AVP fraction refers to the letter by the Dutch ministers Ben Bot of Foreign Affairs, Rita Verdonk of Foreign Affairs and Integration, and Alexander Pechthold of Governmental Reform and Kingdom relations dated September 9 to the Governor of Aruba. In said letter the three Dutch ministers request the Governor of Aruba to start an investigation into the "issuance of stay permits" and "the degree in which the minister of Justice makes use of his discretionary authority with the allowance and admittance of foreigners, as this would in fact eradicate the visa duty.

The articles in the Diario published two checks. The first one is signed by 'Aruba Tigers Org. a/o Oslin Quijada' for an amount of 5,000 florins. The article identifies the beneficiary of this check as a government official who works at the bureau of the minister of Justice, according to Diario the right hand and advisor of the minister of Justice. A second check was for 2,500 florins and was made out to Fundacion Pro Rudy Croes. According to both articles the checks were made to fix permits. Allegedly coordinators and campaign co-workers of the minister, Juan Lopez and Edward Croes, stipulated payments from companies to handle and grant work and stay-permits.

Furthermore a businessman stated last week in a radio-broadcast that during a personal conversation with Rudy Croes concerning a work and stay-permit for personnel in his company, he was referred to Croes' cousin Edward Croes. In a conversation with this Edward Croes the businessman was informed that he would have to contribute to the minister's campaign in order to obtain the permits he had requested. The businessman consequently adhered to this condition. According to the businessman several other members of the minister's bureau also had to be paid off in order to obtain other types of permits.

The AVP believes the articles and radio broadcast are indications of felonies committed by Croes and his co-workers. The party urges the DA to start a criminal investigation. The party wants to know from the attorney general if the articles and radio transcripts delivered by them is enough to start a criminal investigation.

Comment: Jossy is exposing some of the Croes' dirty laundry for what I suspect is their hindrance in the Natalee Holloway case.

In a case related to tourism in Aruba, the Amigoe informs us of radar problems at all the airports in the Netherlands Antilles:

Air traffic in Aruba in danger

ORANJESTAD -- Delays in the air traffic from Aruba are so substantial that several airliners are considering suspending their flights. Apparently the main reason seems to be due to the malfunctioning radar in Curaçao, the use of outdated software and an unreliable radio communication between the control towers of the Reina Beatrix and Hato airports. American Airlines already threatened to cancel the connections between Aruba and San Juan in Puerto Rico.

The association of traffic conductors in Aruba indicated that the service from Curaçao's end certainly left a lot to be desired, but that the problem did not only focus there. The radar doesn't only malfunction in Curaçao; it malfunctions in Aruba as well. The omni directional beacon at the Reina Beatrix airport has been out of service for approx. a year and a half. The one in Curaçao on the other hand is still operational and according to the Aruban traffic conductors it accounts for better results. Another point that can't be blamed on Curaçao is the fact that the flight connections between Aruba and the US have increased in frequency and thus also the amount of traffic in the airspace.

Comment: This radar malfunction may cause more problems for Aruba than any boycott.

On the question of Dutch trrops going to assist in Afghanistan, the Dutch parliament feels confident in the support:
Expatica's Dutch news in English: Cabinet dismisses talk of an Afghan crisis

Government Reform Minister Alexander Pechtold said on Tuesday he was "absolutely not afraid" there would be a crisis within the coalition government over the decision whether to send a new military mission to Afghanistan.
He was responding to anonymous reports D66 would walk out of the three-party coalition government if

Nato agreed earlier this month to boost the International Security Assistance Force (ISAF) from 9,000 to about 15,000 troops next year. There are currently 600 Dutch troops in Afghanistan.

The D66 faction in parliament is against sending 1,200 troops to the southern Afghan province of Uruzgan as part of an expanded Nato force in Afghanistan.

MP Bert Bakker of D66 refused to speculate on a possible political crisis on Tuesday, but he said the Afghan question "was considerably heavier" than the row about compensating the public for high energy costs.

That disagreement almost led to the collapse of the coalition earlier this month, Bakker told a radio programme.

Bakker said it was likely the cabinet would vote in favour of the mission on Thursday. MPS will debate the issue in January.

Comment: We published a parliamentary crisis over this info earlier. I thought it was interesting that their meeting on the issue will occur in January 2006. There are lots of US-Netherlands issues being discussed in January 2006!

From the cable News Networks, Rita Crosby of the MSNBC News interviewed Steve Cohen, John Kelly, Dave Holloway and Richard Parton. Steve Cohen reported that Joran van der Sloot returned to Aruba today, and he will be questioned by police sometime in the next ten days. Steve reported that the Kalpoes will be interviewed, as well. Steve stressed that there will no re-arrest, just interviews, not under oath, concerning some timeline discrepancies. Also, these interviews are no surprise. The attorneys for the suspects have known of them, since Joran left for Holland to go to school.

John Kelly felt good about the re-interviews of the suspects.

Dave Holloway likewise felt good about the interviews; however, he felt letdown that the suspects will have time to get their stories together again. Steve Cohen ameliorated Dave comments with the knowledge that Joran was aware of these interviews for months.

Steve returned informing that the attorneys for the suspects would be present for all the interviews.

Rita actually asked if John Kelly could attend the interviews. What a joke!

Lastly, Richard Parton, Layered Voice Analyst, gave a rendition on how his state-of-the-art equipment detects information and discrepancies from a person's voice. Richard made an attempt to exhibit a kind of voice blueprint that was decipherable. Personally, I felt the psychic Allison Dubois was more credible than Richard and his state-of-shamanism contraption.

Contrary to the absurd propaganda coming out of someone's backside and personally fueled by the Van der Sloot family, Natalee Holloway is still...dead. This is not a runaway. This is not a spoiled girl who decided to ditch her parents. This is not someone who heavily drank and was out of her mind to the point that she stumbled onto a boat and headed for the South America.

This beautiful child, tragically, is dead.

And, because the disposal of her body was so effective and the excuse that night was so pathetically shallow followed by one of the most inept investigations in human history, Natalee Holloway will never be found and three boys and a father will get away with either causing her death or covering it up. Gee, I wish I could be proud of myself in defending them. But, unfortunately, I like to sleep at night. My self-respect, for some reason, remains important to me.

But, if I were one of their friends (or perhaps even Paulus Van der Sloot disguising my identity with an alias as I wrote about my opinions on the case) I would do everything I could to point the finger at the grieving mother. Of course, I would reason, it is the parent who is to blame for the child's being sexually assaulted, murdered and tossed into the sea as though she were the carcass of a diseased tuna. Beth Holloway Twitty is to be despised, demeaned, dishonored and deceitfully portrayed as a monster with every turn of my phrasing.

I mean, look at all the mistakes she made!

If she had not allowed her daughter to go on a senior trip to Aruba, Natalee would still be alive. If she had raised her properly to never flash men from a car. Natalee would still be alive. If she had not gotten divorced. Natalee would still be alive. If she had married Jug, Natalee would still be alive. If Matt's grandmother had not innocently bought a Toyota Tundra for her grandson, Natalee would still be alive. If she had not interviewed with Greta, Sean, Joe or Dr. Phil, Natalee would still be alive. If she had trained her daughter never to let someone else use her toothbrush, Natalee would still be alive. If she had not gone to her friend in Philadelphia or to the Governor of Alabama....Natalee, of course, would still be alive.

Clearly, if I was trying to convince the world that Joran and the Kalpoe brothers were innocent, I would do everything in my twisted way of thinking to attack a mother who was doing everything she could to find her missing daughter. My justification for these illogical attacks that made no sense to anyone outside of Aruba was because I did not want my personal friends, the Van der Sloots to ever be found guilty for their involvement. How could ANYONE suspect that sweet little family with their honors student son had ANYTHING to do with the disappearance of a slutty girl with a bitch for a mom that night? Right?

Even if no one else was even interested in the case any longer and even if I had the ability to write about other issues, I would still keep attacking and lying and making fun of a family who has lost their daughter and is hurting beyound belief because it fit my mission in life: To protect those who the rest of the world puts into a category with Scott Peterson, Ted Bundy and Robert Blake.

At some point, anyone who reads these ongoing missiles of venom attempting to journalistically rape and murder Beth Twitty (just as the boys did in reality to her daughter), is going to wonder why a writer would not allow the use of his real name and his true identity to emerge like all the rest of the writers in here who are willing to be far more honest about themselves. For if one uses an ongoing alias and lies about their profession, how can they have any credibility in what they write?

And, folks, that is why I do not take any of those articles claiming that this young girl faked her disappearance just to get away from mom in a remotely serious way Neither should you.

Natalee Holloway is still dead.

Dear tex:

Thank you for the post. Are you agent for Pat Hurley? Does he need work writing for someone? He wasn't a scriptwriter for the Dr. Phil Show, was he?

If you know this 3-Emmy-Award Pat Hurley in Southern California, you might refer his name and contact numbers to the FBI. They will want to hear his proof that Natalee Holloway is dead. Better yet, you could ask him to post here on our site. I, for one, am quivering with anticipation to read it.

"If the foregoing four resolutions exemplify an example of the Alabama administrative prowess, we can certainly appreciate why the federal government instituted the No Child Left Behind Act. Alabama has been left behind."

I don't know whether this is Harry Tho, or still the unknown "paul"; however, those five lines are the most scathing that I have read in a long time.

Beatifully phrased, and a paragraph that, hopefully, the Alabama voters will see a lot more of, the next time an election rolls around.

Aruba has very little if any tourism from Alabama and Arkansas -- sign Missasssipasss join the boycott too. It just opens up doors to other tourist who couldn't find a room in Aruba, even at the Holiday Inn.

NATALEE HOLLOWAY IS STILL DEAD?
Golly gee.
Well, I AM the FBI and PAT HURLEY should call me me immediately!

BETH TWITTY has forever corrupted the possibility of my ever believing anything she or her minions may ever say.

Sadly, I am the type of person from whom BETH TWITTY would want to garner support. However, while I would like to know the truth about NATALEE, BETH TWITTY's ongoing fantasy of culpability, coupled with her vaporous vindictiveness against anyone who is not on her page, leaves me disinterested at best, if not resentful for her intrusions into the media.

I think it's time for PAT HURLEY to go back to writing and hosting his TEENAGE TALK SHOWS.
He and Beth are certainly not working in the adult world.

Re: the Resolutions

I used to organize fundraisers for events. For some events we would have the Mayor's office issue a proclamation for that Day. The Mayor's staff would ask us to send over a draft of some of the things we would like to see on the proclamation. They would edit it, or add selections from the draft, compose it in the "Whereas style" and you could pick it on Friday. These sound like the Federal version of a proclamation.

Posted by: pathenry at December 22, 2005 4:10 AM

Thanks again for your post, Harry!

The repeated use of 'Whereas' followed by a statement could very well be the correct formal way of 'building' a resolution, how silly it might seem.

See this 'form'for example: http://www.legislature.state.al.us/codeofalabama/1975%2D03dec2004/15%2D13%2D128.htm

Tex .. Whether you want to hear it or not, Pat Hurley simply believes what you do. I know who you are Tex. All one has to do is read your posts at Scared Monkeys to see how angry and involved you are in this case. You're obviously going to great lengths to show everyone just how negatively this case and it's present status has affected your own personal life. I think it's sad to see the manner in which a missing persons case can affect someone like you, unless of course, the missing person is your sister, mother, brother, father, uncle, aunt etc, which is obviously not the case.

Let's face it Tex. Your young mind has been taken in for whatever reason, without your consent (let us pray this is true) and you have consequently, and may I say freely, without one shred of legal proof, constructed "THE" DEMISE" of Natalee Holloway. Not to worry though. You are not alone.

Tex, I would be so proud of you if you would just once sit down and tell me why you constantly state on every blog you visit, that Natalee Holloway was gang raped by - what is it now - what's the "new wave jargon" - JVDSK2 (Is that right?) - and buried by PVDS (is that correct as well?) - and of course this was all covered up by "PapaVDS" (Is that correct Tex?) - Arubans are scum .. anyone who doesn't agree with this is an idiot. "The whole world is watching!" ... there's a current catch phrase that's embraced by twerps like you, right Tex? The whole world is watching. What an ignorant statement. Tex, I have two kids older than yourself, 23 and 25, and they don't even know who Natalee Holloway is. They have their lives to take care of. They're having fun. They're sowing their oats. They don't seem to care yet about missing people. None of their friends or relatives have gone missing except their mother who died of cancer 7 years ago. They're carrying on Tex. They smile every day.

So what's your excuse Tex? Do you know how proud I am of my kids? No, you don't. How proud is YOUR dad Tex? How proud would he be if he knew how deeply involved you were with some randon missing persons case that has been astronomically blown off the map by a mother and the US media? Could it be that he's obsessed about it as well? Tell me Tex. I want to know. To tell you the truth, I'd like all of you twerps that sit behind an anonymous keyboard and have this "special gift wrapped" version of Natalee's death embedded upon your little brains, branded, till the day you die, explain WHY you feel you have tenure to tell everyone you possibly can about what YOU and your little cohorts on the net have seemingly WITNESSED firsthand. To tell you the truth Tex, no-one knows where Natalee Holloway is. At least not us. Someone does I'm sure, but until this is proven, you should realistically refrain from what you're doing.

It doesn't really matter to me what you think of me Tex, at least when I post something about this case, I use personal experience or known facts to try and back up my point. At times, I sometimes get a little personal about my experience, but I'm not afraid to talk about myself.

Speaking of tenure Tex, I can assure you that I have every right to criticize what I have personally seen YOU and others like you post about this case. To put in in simple terms, it's disgusting, slanderous and uncalled for.

Posted by: Jim Hanson at December 22, 2005 6:03 AM

Tex, due to my above post regarding your mentality about this case, and your seemingly limited abilities, I felt it necessary to post something you wrote on a blog very recently, in the hopes that you will only call me whatever you will out of sheer anger only.

for Bachus that was a polictically correct way to say - i’ll give you a chance. he never stated in the news i commend the aruban authorities on their investigation. he never stated beth was wrong. bachus is just a state representative, not the voice of alabama. beth never denied the mountain brook youths from being interviewed. aruba just declined to do it themselves and when aruba realized they were loosing the battle, they decided to blame beth. more lies and spins.

the americans on this web-site raised numerous valid complaints and suspiscion on the way the aruban le, gov’t and residents of aruba and netherland handled the investigation. if beth hadn’t done it, it would have been sweep under the carpet. we are an army of one - the southern cross, americal and many of us stick to together in battles of this magnitude.

none of the americans on this web-site vocally victimized the three suspects, aruba le and gov’t the way the arubans and dutch did to the victim and family. the arubans and dutch slandered the victim and beth on tv, web-sites and in the news. the arubans, dutch a few others slandered the victim and family publicly w/o mercy.

there was too much that went wrong, the gov’t of aruban did something terrible, and once that was done there was no turning back - got news for you; it can not be undone! beware of your future -

one year ago natalee was a happy teenager in high school enjoying christmas holdiay season, probably writing away to colleges to inquire about admission. she was probably going to parities, dating and having a wonderful time. as spring came she was preparing for a trip with her friends to an island called aruba. she was probably very excited for this grand celebration.

then one night three sexual predators did the unbeleivable - took her life in a vicious rape and murder. and you want us to forgive - go to church ask your god why you should be saved and forgiven. you were denied?

Unknown Paul - if you had read all of the previous posts you would know my name and where I live. I found the monsy connection between Bachus, Riley, Shelby, and Sessiosn to the Netherlands PACs.

Anyway,

The upcoming year is an election year in Alabama - all of the state reps who proposed the resolutions are up for reelection - the Twitty area reps and congressmen all got money from AmSouth last trip around and will again this trip.

The lack of attemtion to other MIA in Alabama is partly political - most are Democrats. A Birmingham school principal - MIA since July 05 has not yet had a reward made by Governor. He is or was a Democrat and a strong supporter of Paul Hubbard and Teachers Union.

As far as the quality of attorneys in Alabama.
Johnny Cochrans firm is in Birmingham. Like his position or not he won a lot - a very high percentage lot.
The highest paid litigators in US reside in Alabama - check the ABA press.
The best lawyers do not go into politics - but they can buy the politicians. So can businesses. Banking and Insurance are Bob Rileys key to election success.

Bob Riley is opposed for Republican nominee by Roy Moore. The Birmingham news has stated it will be a contest of who can out Jesus the other.

The boycott show is a vote getting show by Alabama politicians. The Amsouth and McWane contributions for 2006 will not start showing up until March reporting in 2006.

If you follow the election in your own state or country next year and document the stupidity, lies, and BS - why you would think you lived in Alabama.

Posted by: paul at December 22, 2005 10:49 AM

I do live in Alabama and find our political leaders totally out of touch with reality. We are so far behind other states in more important things like education that it is sad. Instead they waste time on stupid petty matters like a boycott of Aruba or how much should we raise our salaries. It is funny but a lot of the people in Alabama are as stupid as the politicians. They gripe about poor education and yet voted against the lottery and voted against a tax hike to help fund schools. Yep they still harp about poor education in our schools, what do they and our politicians expect that money is going to grow on a tree or fall out of the sky magically.
I am sorry I have voted many many times against the idiots we have in the legislature and more so in the governor's seat. I will also say I certainly don't want Roy Moore being our next governor(who wants someone who broke the law by going against a federal jury's ruling leading our state).
Anyway, I for one still believe that the truth of this whole Natalee Holloway case lies in Mountain Brook under tight wraps. I also believe that Beth is nothing but a media crazed fanatic who will do anything to get in the limelight.
You know what is funny is that in my state some of our local news stations don't discuss the Natalee Holloway case every night like the cable news stations do. I am glad our local news stations are covering other news worthy events in Alabama.

@tex : Clearly, if I was trying to convince the world that Joran and the Kalpoe brothers were innocent. You should try a bit harder, but you can NOT no evidence is there to prove that they did wrong. There is statements that their own classmates saw her after she was with Kalpoes that get her in their car, and JORAN that left her in the beach. Imagine you know the rest of the story, she disappeared, and bla,bla,bla..
About the author: Pat Hurley has won three Emmy awards for writing, hosting and producing television shows. He resides in Southern California. i.e. Scary Movie 1,2,3. ??
By the way Monsieur Harry, you and Dan should be the ones to win the Awards you write REALITY, looking at both sides of the coin.
I going to the post from: URGING CONGRESS TO REQUEST ARUBAN AUTHORITIES TO COOPERATE WITH UNITED STATES LAW ENFORCEMENT AGENCIES; What does this people mean?
* Dutch youth who admitted he was alone with Natalee Holloway in the early hours of the morning she vanished.*
Then they go to the tourism. is this the way it should be or this is a law transcript or what? My interpretation is like Mr. Bush is talking about Iraq suicide people and in the middle he gets to discuss about the price of the tomatoes.

Pat Hurley's claims about winning three Emmy awards appear prima facie false. Search of Emmy site shows none. Of course, it is possible to argue that he could have won in some minor categories not shown at the main site, but it still doesn't seem the case.

The issue was brought up at the UK site, and rather than to clarify what he won, Hurley has choosen to mere repeat claims a few times, then to advocate gang-raping of the author questioning his "awards".

Even the less than lawyers elected to Alabama legislature are absolutely aware of one hard and fast legal rule ;

"Guilty until proven innocent".

While not proclaimed as the fact that it is, just try an experiment. Pick any defense attorney in your town and call him and ask him if procedure is not "Guilty Until Proven Innocent."

The media pundits who are attorneys have made a career of Guilty Until Proven Innocent. Nancy Grace was sanctioned four times by judicial oversight in Georgia for going to trial without giving all the evidence to the defense. Governor Sonny Perdue might just be in line for some good press from Grace - she is based in Atlanta. Likewise Abrams lack of rapport with those who see things not in his way.

The majority of District Attorneys are elected based on conviction rate. No prejudice for guilty till proven innocent is implied , just practiced.

Any case that makes it to media is tainted by pundits position. They bank on their viewers lack of time needed to investigate facts.

Guilty Until Proven Innocent may be the cause of the great increase in prisoners released after being proven innocent with DNA - oops.

Alabama DA Troy King, a Bob Riley handpicked replacement for Richard Pryor - a Bush appointee, is leading the charge for guilty until proven innocent. King instituted a statewide inspection of all gas stations in Alabama who he accused of inflating gas prices. They found one - thats one - and spent $6million protcting the citizens from this one gas station. King has to put on the show hes up to be in an election in 2006 - something he has never done before. King is also supportive of the slow pace of the two - count them - two certified forensic examiners in Alabama criminal system who have been proven to have been negligent in DNA evidence analysis. They don't know how to run the machines. Unlike all other science labs the state and federal labs certify themselves internally, no oversight by FDA, or CLAI, and certainly not by defendants.

Its guilty til proven innocnet in the USA. Apparently Aruba does not hasten to the beck of Guilty Til Proven Innocent as quickly as we do. Now Jossy Mansur will if he gets his opponents kicked out.

Check out the 12/21/05 Diario. They make note of Bob Rileys plan to call for Boycott at National Governors Convention in Feb. 2006. Riley made the announcement on wiat (wiat.com) in Birmingham on Monday between 6 and 6:30 am. In the same
interview Riley points to the boycott as an accomplishment of his term in office. He just got the guilty till proven innocent vote.

Dear Kienstail and any interested others:

Let me help you with this "Whereas" controversy. The term "Whereas" is employed in many legal documents. When the word "Whereas" is used, it refers to a possession of the author (Grantor). Accordingly, "Whereas" will be cited in real estate documents or contracts involving partnership, franchise and/or licensing (among other such documents). The key is that the term "Whereas" implies some form of ownership. As for your query concerning resolutions, the term "Whereas" can be used, provided your resolution emanates from some form of ownership.

When you lack ownership or you are engaged in another type of resolution, you are required to acknowledge the reference authorizing your actions. Secondly, if you do not own the item of resolution, then you are required to boundary that portion to be effected by the resolution. Lastly, it is imperative that you state clearly your objectives to be achieved from the resolution.

Had the legislators of the state of Alabama acknowledged their reference for advocating such a resolution, they would have realized that they were not a sovereign state. The shortcoming of the authors of the Alabama boycott resolutions etc. was not so much their belief that they could do anything, it was the false sense of security that they immersed themselves within when they employed the word "Whereas" vice the word "Acknowledging."

The authors of the Alabama boycott resolutions crafted the documents as if they were handling a real estate transaction. They completely overlooked the fact that Aruba was a sovereign nations outside their control or ownership. In a sense, the employment of the long list of "Wherases," climaxed with a "Be It Resolved," sounds like Governor Bob Riley is standing before the legislature, beating his chest and saying: "Me Alabama, you Aruba," then he proceeds to yodel the Alabama State anthem, accompanied and harmonized by the legislators.

Whatever we make of the resolutions, the good people of Alabama paid for this display with their hard earned tax dollars. For what? Was it for one missing teenager from the affluent part of Mountain Brook, Alabama whose step-uncle is a big shot with $50-billion asset bank? That is a lot of yodeling!

Lastly, your link identifies a bail bond transaction. I pray you can envision the ownership in the document, warranting the use of the word "Whereas."

With Aloha,

Harry

The following may well be a legal basis defining the illegality of Aruban Boycott based on present US law.
Law originally enacted at Jimmy Carter request to protect Israel from boycott by Arab League and others.
Law is not specific to Israel and could possibly be basis for making Bob Riley look a dolt.

http://www.divestmentwatch.com/usdocs.htm
PROHIBITION AGAINST REFUSALS TO DO BUSINESS

(1) No United States person may: refuse, knowingly agree to
refuse, require any other person to refuse, or knowingly agree
to require any other person to refuse, to do business with or in
a boycotted country, with any business concern organized under
the laws of a boycotted country, with any national or resident of
a boycotted country, or with any other person, when such refusal
is pursuant to an agreement with the boycotting country, or a
requirement of the boycotting country, or a request from or on
behalf of the boycotting country.

(2) Generally, a refusal to do business under this section
consists of action that excludes a person or country from a
transaction for boycott reasons. This includes a situation in
which a United States person chooses or selects one person over
another on a boycott basis or takes action to carry out another
person's boycott-based selection when he knows or has reason to
know that the other person's selection is boycott-based.

(3) Refusals to do business which are prohibited by this section
include not only specific refusals, but also refusals implied by
a course or pattern of conduct. There need not be a specific
offer and refusal to constitute a refusal to do business; a
refusal may occur when a United States person has a financial or
commercial opportunity and declines for boycott reasons to
consider or accept it.

(4) A United States person's use of either a boycott-based list
of persons with whom he will not deal (a so-called "blacklist")
or a boycott-based list of persons with whom he will deal (a so-
called "whitelist") constitutes a refusal to do business.

Posted by: paul at December 22, 2005 5:11 PM

Dear Harry,

It seems to me that the clause "when such refusal
is pursuant to an agreement with the boycotting country, or a requirement of the boycotting country, or a request from or on behalf of the boycotting country" may relieve Alabaman Bob from liability under this law, since there is no "boycotting country" to whose demands he might have subverted.

Your move to another server could not affect your standing with Google. As to difference in our output, it is due to various settings, whereas yours is "to show 10 links per page" (default) and I set it to "100".

Dear George & Paul:

First, thank you, Paul, for the post. It seems your post on boycotts implies a general refutation of all boycotts. The author does not distinguish between primary and secondary boycotts. Although within the text, we see both addressed anonymously. The main issue emanating from your post is that US person cannot partake in a boycott of another country whatsoever.

As for George's comment, even though the language may appear to provide an escape for Governor Bob Riley under what has been written above, we must remember that under any circumstance a secondary boycott is illegal.

As a refresher, a secondary boycott occurs when a party to a primary boycott influences a party not connected to the primary boycott to boycott. Governor Riley initiated a secondary boycott when he informed some 6,000 travel agents worldwide of Alabama's decision to boycott. He likewise committed action for a secondary boycott when he wrote to the other 49 governors, encouraging them to join Alabama. Please note how Arkansas and Georgia responded affirmatively: "I have received a letter from Governor Bob Riley of Alabama. He has provided me with reasons that I should boycott Aruba..." (or words to that effect). Clearly, both governors are citing a secondary boycott act by Governor Riley as their basis for calling for a boycott. In other words, if the boycott goes south, then both governors will have an escape clause and dump the entire liability upon Alabama.

Also, in the laws quoted above, a person can be considered an entity like the state of Alabama or Governor Bob Riley himself.

We must keep in mind that regardless of the outcome of the boycott, Governor Bob Riley and his Alabama legislature have take upon themselves the mantle of sovereignty and performed an illegal act. Even the resolutions of the Alabama legislature are worded to omit their obvious lack of sovereign status. Clearly, the Alabama legislature has acted outside the law ... they are outlaws!

Harry

For any of you out there who enjoy writing pieces to express your opinions on subjects here, please be advised that there is a danger to your freedom of speech.

If you happen to disagree with Dayo Gould he will do everything in his power to see if you can be sued and will do background checks on your reputation and personal life. I find his tactics disgusting and a deceitful. Once I exposed his lies as he tried to question my three Emmy awards, he shut up for awhile. But, his article today, attacking me personally and threatening me with a lawsuit because I told the truth about Joran Van der Sloot and his two cohorts is absolutely disgusting and beyond the pale, (as he would put it) of human decency.

How dare you, Mr. Gould!

If someone wants to sue me for something I have written, they know where to find me but it is none of YOUR d@mn business you sick b@st@rd.

The only redeeming quality of your writing is that it is far too discombobulated and vague for anyone to understand your literary ramblings. But, if you EVER threaten me again in here with legal action, I will get an attorney, hunt you down and make you pay for all the people you have hurt in here with your demonic assertions that have no basis in fact and no justification in truth.

You are obviously a shill for the Van der Sloot family and Aruba, fine. But, lay off the legal talk Gould, because you are way out of line here. The Van der Sloots are not going to sue anyone because they want the light to go away from them knowing what they did. Your insinuations about legal action against me is inappropriate and it reveals how far you will go to attack writers in here beyond reason. You said Meri Ulrich had a mental illness and I have received several private emails from others who wish to remanin anonymous because you threatened them with lies about their private life.

A warning to all you writers in here. Do not be intimidated by the threat of a lawsuit from Dayo Gould. Just know how vicious his methods are how he and will do anything he can to hurt you if you disagree with his theories on what happened in Aruba to Natalee Holloway.

He does not belong in here for the legal threats he makes against other writers.

The Dutch cabinet has made no decision, but instead have recommended to take part in further operations in Afghanistan, but the cabinet will leave it to the parliament to decide.....

FYI the parliament is 99% against a new mission in Afghanistan. It will take till March for any decision, so Bush will have to be nice to us in the mean time ;-)

Tex, I don't come here to read reposts of Huxley's regurgitated output, which has remained firmly focused for the last six months on the prolific production of pap-filled paeans praising all things Holloway and Twitty(dung beetles can't deviate from their preordained tasks); I come here to read the writings of people who are willing to think outside of the box--the black box of HollowayMedia Inc's making.

Hurley is meaningless: IMO, a someone whose miserable hundreds are due to be owned by Arubans; he just hasn't had the papers served on him yet.

Hurley spends an inordinate amount of time speculating, fantasizing and writing about what is in my breeks and in the breeks of the young van der Sloot lad.

With my apoligies to the board, I'll repost the new rectum that I cut Hurley a few months ago in the futile hope that, with a new one of his own to play with, he wouldn't have unsettling thoughts about mine and Joran's.

Natalee Holloway's Mother: To You From Failing Hands We Hurl

By Dayo Gould
Sept. 18, 2005

Patrick Hurley, that prolific Holloway penman (47 useless-knowledge pieces since June 29...39 of them pro-Holloway paeans) takes up arms for Beth…yet again.

A predator, am I, deemed to be taking aim at a defenseless Beth Holloway? Can this be the same Beth Holloway who has the unrestricted use of an estimated $20-million in donated funds; who has recently been given unfettered access to Dr. Phil’s multi-millions, which can be applied to further her vendetta of vengeance against an 18-year-old Aruban honour student and his highly respected father; and who has public relations persons and lawyers numbered amongst her ever-present entourage? The same Beth Holloway who has, and has had for seeming ages, on-demand access to the ears (and camera lenses) of the talking heads at FOX, MSNTV and CNN?

Come, come, Patrick, hurl not that untruth at me. Should anyone wish to watch a real predator in action, read the following excerpts from Patrick Hurley’s articles as he skillfully stalks, hamstrings, smears and judges a defenseless 17-year-old boy whose father, as an appointed official in the Aruban judicial system, can make no public statement on his son’s behalf.

“…Joran Van der Sloot has changed his story EIGHT times. I have news for him. There is a mother out there who is not going to let him get away with that…” June 30 “… Four suspects who were arrested have been released, including the enigmatic Paulus Van der Sloot who has become the poster child for why someone should NEVER disappear in Aruba late at night….” July 1 “…Scott Peterson is a classic psychopath in the same criminal bloodline as Ted Bundy and Dennis Rader… Joran has the same exterior makeup as these guys…From someone who has studied the minds and attitudes of psychopaths, I think I know the answer...”July 5 “…If Joran Van der Sloot owed a debt to someone and could not pay them back with his own money, he could have been told to pay with something or someone else…” July 5 “… Someone said they saw Joran punch Natalee in the face. Did he? It would fit the scenario that many believe happened. Can it be proven? No… If Joran Van der Sloot was crafty enough to make Natalee disappear, it is unlikely he is going to trap himself on a cell phone or a computer transcription…” July 16 “…There is no case, as it was so eloquently put by the elder Van der Sloot, because the…remains…will never be found now. The absence of that wonderful girl is a ticket to freedom for the three boys who saw her last…The injustice here is that the lie always trumps the truth if the lie is good enough. In this case, it was. As Joran kept changing his stories, the lie got better and better until it finally protected him. He worked hard to find the right combination of words to save his skin…”

I ignored your first public slight (and those three private e-mails, lol), Patrick, and incorrectly assumed that it was safe to turn the other cheek, presuming that your head is so deeply embedded between the Holloway-Twitty camp’s nether cheeks as to render you oblivious to everything other than that which is found there.

Oh, my. I seriously underestimated the power of the almighty dollar. Joran can’t access the $20-million in donated funds; it would be futile for me to forward an invoice for my scribblings; but something has moved Mr. Hurley enough to take him away from his day job and the garnering of Emmy Awards, and to sufficiently motivate him to pen 39 purportedly-for-free character attacks on a 17-year-old youth and his family.

And what is the Hurley day job? From what I can garner, Mr. Hurley is a for-fee motivator of students, teachers and parents. His picture, at http://bureau.espeakers.com/jost/viewspeaker4286, shows a smiling, avuncular, and benign individual--totally at odds with his role of prosecutor, judge and executioner in all matters Van Der Sloot. Distressingly, there is no sign in the photo of the oft-mentioned, cherished daughter…or that dearly beloved and well-travelled leather jacket.

But wait, there is more. The Lutheran Church, at http://www.uss-elca.org/video6.htm, describes him as a Christian comedian and youth speaker as it attempts to sell website viewers an innocuously titled item from his stable of teen-help videos.

Seemingly, he is a veritable Benny Hinn of the high-school circuit, but there is nothing there to indicate why he felt compelled to initiate his cowardly series of 39 personal, public attacks and libels on the hapless Van Der Sloots (and let’s not forget my two slights and three e-mails).

Has Patrick appointed himself to be the figurehead and sole in-print champion for the well-funded, well-lawyered, well-represented Beth Holloway-Twitty in her battles to wrest justice from Aruba, wreak havoc upon Holland and possibly, just possibly, topple Queen Beatrix from her throne?

If you have, Patrick, I don’t think you are quite up to the task.

In one of the Crusader's last battles the Christians, desperate for a fitting figurehead to strike fear into the hearts of their foes, disinterred the body of El Cid, wrapped a suit of armour around the bloated, stinking, suppurating corpse, strapped it onto a charger, and led it into battle behind his colours, pennants and flags.

The ploy worked. The battle was won—but the war was ultimately lost. El Cid? He was unhorsed, stripped of his armour, returned to his tomb and reburied, as he was only a bloated, dead, empty shell---as are you, Patrick Hurley.

Probably for a reason - that UK article is followed by the note "All articles are EXCLUSIVE to Useless-Knowledge.com and are not allowed to be posted on other websites.
